Bankruptcy

Are my student loans dischargeable in bankruptcy?
Federal student loans are not dischargeable in bankruptcy unless you have filed a Chapter 7 action with a Petition of Undue Hardship.  Consult with your attorney if you have any question whether you have filed such a petition.

Do I need to continue making payments on my student loans while in bankruptcy?
Your lender or servicer is required to suspend payments due and all collection efforts on your student loans while you are in a bankruptcy action.  You need to make sure, however, that your lender or servicer has been notified that you are in bankruptcy.

What happens when my bankruptcy action is over?
When your bankruptcy action has ended, you will need to resume repayment of your student loans.  Your lender or servicer will regard the period of your bankruptcy as a forbearance period.
